PM not a monarch that he has liberty to spend on his sweet will: CJ

ISLAMABAD, (monitoring desk): Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry has remarked “Prime Minister (PM) is not a monarch that he is at liberty to spend whatever he wills.
He gave these remarks while presiding over a 3-member bench of Supreme Court (SC) during the course of hearing of misuse of development funds by former PM Raja Pervez Ashraf here Monday.
CJP further remarked “government employee
husband and his wife died of cancer but no help was extended to them. On the other hand billion of rupees were spent on unnecessary schemes. This was done good or bad but the avenues of corruption came to light due to court’s interference. Not only illegal orders like this were issued from the past till now but the institutions showed their loyalty by implementing them. Threats were given to AGPR office to bring it under their ambit. Telephone calls were made and the amount was approved by sending representatives.
Justice Jawad S Khawaja remarked “no project in Balochistan is transparent. The construction of the roads whose contracts were awarded after getting money was not completed.
Khawaja Haris counsel for Balochistan government argued the discretionary powers of the former PM is not in consonance with the constitution.
CJP remarked “on one side people are committing suicides and on the other hand money was released through illegal way. As to why no amount was allocated for emergency expenses in the budget. Expenses are protected through supplementary budget. Doling out money to please the favorites can not be allowed. The benefits of national coffers should trickle down to the common-men which are not reaching them. PM doled out money in arbitrary manner apparently. PM is not a monarch and he is elected representative. Local bodies’ institutions and not the parliament are form of development projects.
Khawaja Haris said elected representatives are the fittest persons to identify development projects. The administrative departments implement them after the proposals are received.
CJP remarked “what is justification of identification of the projects by the non elected notables. Who are the notables those reach the office of PM and get allocate funds. The opponents can not even reach the office of deputy commissioner of PM.
Justice Azmat remarked “releasing the funds on the occasion of polls does not show good intent. Utilization of discretionary funds demands good intent.
CJP remarked” how does the AGPR approve against the rules expenses. The court had to stop the illegal use of funds in this case. This was job of AGPR and not ours. AGPR does not budge if the matter of releasing funds for common man comes. One pensioner and his wife died of cancer and funds were not released and in this case billion of rupees were released.
Khawaja Haris said it seemed as if all was done to influence the polls.
CJP remarked it will be injustice with them if amount is not paid to the people who have done work.
Justice Khawaja remarked “litigation will start this way and they will start filing civil suits to get their money. Matter will complicate further.
CJP observed “no compromise can be made to the extent of AGPR.
Justice Jawad remarked ‘every one is equal under article 25. The wealthy person became notable and nothing has to be given to the poor.
Khawaja Haris said Nargis Sethi had given the proposals of monitoring which were not even seen.
Khawaja Haris completed his arguments.
Justice (Retd) Tariq Mehmood said 32 contractors gave applications on the advertisement given with reference to development projects.
Justice Jawad remarked there is not a single project of Balochistan where transparency is ensured.
CJP remarked the officers sleep earlier and all connive with each other. When the SC has taken notice now then all have come to take credit.
Justice Jawad remarked every single pie is hard earned money of the people. We can not give approval without the scrutiny by Accountant General.
General said whatever amount was released we had released it to the advertising agencies.
The court reserved the judgment on completion of hearing of the case. The court also ordered for registration of civil and criminal cases against the officials found involved in violation of para rules and the contractors who obtained contracts illegally.
