Those imparting lesson to others to abide law are defying the law: SC


ISLAMABAD: Supreme Court (SC) has observed those imparting the lesson of abiding the law to others are  defying the law.
A 3-member bench of SC  presided over by the Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry heard National Police Foundation (NPF) case here Tuesday.
CJP remarked “ the poor police men are here to receive bullets on their chests while police officers through nexus have purchased all plots and have

started business. Neither any advertisement was given nor the people were informed. The police officers exchanged views behind the scene and purchased plots. The poor policemen are still facing hardships to acquire a roof. No transparency is there and even green area was destroyed. Parks were also changed into the plots of choice. Poor police employees were entitled to these plots but police officers having ranks of IG, DIG, SSP  took advantage and they have no repentance even a jot that they have encroached upon the right of the poor employees”.
All the concerned officers and lawyers appeared before the court during the course of hearing of case.
Ali Zafar said the real issue was Anjum Aqil Khan which is known to you well.
CJP remarked “  tell us if the real issue is Anjum Aqil Khan in your sight or those police officers who have acquired more than one plots. Can police officers get plots for their children. Have they so much resources that they can acquire plots like these being salaried personnel. IG, DIG, DSP  and all officers reaped benefit.
Ali Zafar said he was appearing on behalf of 17 applicants. There are total 11 families on whose behalf I will give arguments.
Justice Ejaz remarked government had provided Rs 20 million and these plots were not carved out of your money. No advertisement was given and plots were allotted quietly to the police officers  whom the police foundation wanted to favor.
CJP remarked “ we have to see transparency. Police man receives bullets on his chest and on the other hand police offices keep on coming, acquiring plots and doing business.
Justice Ejaz remarked “ our concern is this as to why the advertisement was not given in this regard. It is not in the knowledge of any police officer. You applied through back door and plot was allotted to you and your wife. No plots were allocated for  police personnel from lower class.
CJP remarked “ some thing has come in the market . You have to purchase it but you have to see its transparency as well that who was entitled to purchase this plot and who was not.
Ali Zafar said it was a business mission. I got the plot through transparency.
CJP remarked “  you filed 17 applications  but you have not attached advertisement with any one. No proper record including sources of income has been attached with the applications.
Justice Ejaz remarked “ you want to say that transparency in place in 1989 was of different kind and now it is of different nature.
Ali Zafar said every plot has a different kind of transparency and it conforms to the prevailing situation.
CJP reprimanded Ali Zafar remarking “ how can you ask judges if they have understood or otherwise. You are not giving the answers to the questions.
Justice Ejaz remarked “ the real question is this if the plot has been acquired through means  other than competition then it is wrong thing.
The court after hearing the arguments of the lawyers reserved the judgment. (News Agencies)
